1. Controller and the personal data processed
Společnost OMNIA PRODUCTION, s.r.o., registered office Nová 276, Netvořice 257 44, Czech Republic, company ID 26510880, registered in the Commercial Register kept by the Municipal Court in Prague, Section C, Insert 86740 (hereinafter the "seller" or the "controller") processes, within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (the General Data Protection Regulation, hereinafter the "Regulation"), the following personal data:
- first name, surname
- email address
- telephone number
- address / registered office
2. Purpose and duration of processing
The personal data above must be processed in order to handle orders and to otherwise perform the contract, if a purchase contract is concluded between you and the seller. Such processing is permitted by Article 6(1)(b) of the Regulation: processing is necessary for the performance of a contract.
The seller also processes this data in order to keep a record of the contract and for the possible future exercise and defence of the rights and obligations of the contracting parties. The data is kept and processed for that purpose for 10 years from the completion of the final part of performance under the contract, unless other legislation requires contractual documentation to be kept for longer. Such processing is possible under Article 6(1)(c) and (f) of the Regulation: processing is necessary for compliance with a legal obligation and for the purposes of the legitimate interests of the controller.
3. Commercial communications
News and other commercial communications may be sent to the buyer at the email address or telephone number. This is permitted by Section 7(3) of Act No. 480/2004 Coll., on Information Society Services, unless the buyer refuses it. These communications can be unsubscribed from at any time and by any means, for example by sending an email or clicking the link in the commercial communication.
4. Data processors
Personal data is processed by OMNIA PRODUCTION, s.r.o., the data controller. Personal data is also processed for this controller by the following zpracovatelé:
- Website developers and marketing campaign managers, OMNIA MEDIA, s.r.o., registered office Nová 276, 257 44 Netvořice, Czech Republic
- The contact form is handled by Web3Forms, operated by Backpack Labs Pvt. Ltd., which processes the data you enter in the form (name, email, telephone, wedding date and venue, and your message) solely in order to deliver it to the controller.
Personal data will not be transferred to third countries outside the EU.
5. Contacting the controller
The controller has not appointed a data protection officer. The controller can be contacted at slehobr@omniamedia.cz.
6. Cookies
The data controller, as the operator of the website www.omniamoments.cz, uses cookies on this website for the following purposes:
- measuring website traffic and producing statistics on traffic and on the behaviour of visitors to the website;
- basic website functionality.
Collecting cookies for the purposes above may be considered processing of personal data. Such processing is possible on a lawful basis, namely the legitimate interest of the controller, and is permitted by Article 6(1)(f) of the Regulation.
The website can also be used in a mode that does not allow data on visitor behaviour to be collected. That mode can either be set in your browser settings, or you may object to such collection based on the legitimate interest of the controller under Article 21 of the Regulation, which is available at the bottom of the website. Your objection will be assessed without delay. Cookies necessary for the website to function will be kept only for as long as is strictly necessary.
If a visitor objects to the processing of technical cookies necessary for the website to function, full functionality and compatibility of the website cannot be guaranteed.
Cookies collected in order to measure website traffic and produce statistics on traffic and on visitor behaviour are assessed in aggregate and in anonymous form, which does not allow any individual to be identified.
The cookies collected are processed by the following additional processors:
- The provider of Google Analytics, operated by Google Inc., registered office 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
7. Your rights
Please note that under the Regulation you have the right:
- to stop receiving commercial communications at any time,
- to object to processing based on the legitimate interest of the controller,
- to ask us what personal data of yours we process,
- to request access to that data and to have it updated or corrected, or to request that processing be restricted,
- to request erasure of this personal data. We will erase it unless doing so would conflict with applicable law or with the legitimate interests of the controller,
- to data portability, where processing is automated and based on consent or on the performance of a contract,
- to request a copy of the personal data being processed,
- to effective judicial protection if you believe your rights under the Regulation have been infringed as a result of your personal data being processed contrary to the Regulation,
- to lodge a complaint with the Office for Personal Data Protection.
